BOAZ CITY EMPLOYEE SUSPENDED

Boaz Parks and Recreation Director James Darrell Nicholson was suspended, with pay, and is now looking at a charge of Reckless Endangerment  which is a misdemeanor  following a recent argument in the parking lot during a Boaz High School spring football practice.

Authorities say the incident occurred on April 25th, with the altercation stemming from a disagreement between Nicholson and another man, after he allegedly parked his city truck in such a way as to block the view of other people sitting in parked vehicles.

The situation quickly escalated to the point where Nicholson allegedly pulled out a .40- caliber Glock handgun. Police officers responded to the scene after being called by Nicholson.

Following an investigation, he was charged with the misdemeanor, after which he turned himself in at the police department, and was released after posting a $500 bond.

Marshall County District Attorney Steve Marshall stated that the information presented did not warrant a felony arrest, explaining that it must be proven that a person entering school property with a weapon must do so with the intent to do physical harm.

Apparently conflicting statements from witnesses would have made it difficult to prove that Nicholson had actually pointed the weapon in a threatening manner.

The incident has however, been reported to federal authorities.

Both parties involved have been banned from school property until further notice, pending the outcome of an investigation into the matter.
